LICENSE AND PUBLISHING RIGHTS
The Company ensures the confidentiality of your ideas, manuscript, and files. These materials will not be shared with or distributed to any third party unless requested by the Client.
The Company exclusively uses licensed and royalty-free images and fonts in its projects. Additional charges may apply if the Client requests images from stock photo providers other than those used by the Company.
The Client agrees to comply with the terms of any licensing agreement related to images purchased by the Company through third-party providers for book cover design purposes.
By placing an order with FLW Books, the Client purchases a STANDARD license, which permits:
• Unlimited sales and promotion of e-books
• Use of the print cover for up to 500,000 physical book copies
For print runs exceeding 500,000 copies, the Client must purchase an additional license for each stock image that plays a significant role in the cover design.
If the Client intends to use the cover design for purposes other than e-book or paperback covers (such as printing on mugs, T-shirts, etc.), the Client is responsible for obtaining an Extended License.
If the Client wishes to use the logo on merchandise, an Extended License must also be purchased.
The images used for the Client’s cover are royalty-free; however, copyright ownership of the photographs remains with the photographer.
If the cover design is used in a manner not permitted under the standard license, resulting in a breach of contract, the CLIENT assumes full liability.
When providing materials for the project, the Client bears sole responsibility for ensuring the validity of all copyrights, trademarks, and ownership rights.
If the Client supplies materials protected by third-party intellectual property rights, the Client must secure the necessary permissions before instructing the designer to incorporate them into the project. In the event of any intellectual property dispute involving Client-provided materials, the Client accepts full legal and financial responsibility.
The Client agrees to indemnify, defend, and hold harmless the Company and its employees against any claims related to copyright or permission infringement arising from materials provided by the Client.
PAYMENT
The Company accepts payments through PayPal and Stripe.
The Company provides a 100% refund if the Client is dissatisfied with the result. Refunds are not available after the Client approves the design.
Any requests not included in the original brief may incur additional charges. The Client is responsible for verifying the accuracy of all text provided for use in the design.
Unlimited revisions do not apply if the Client decides to change the direction or concept of the cover after work has already begun. Additional fees will also apply for adding extra images or requesting revisions more than one month after project completion.
If the book cover requires advanced or complex Photoshop work, the Company may charge an additional fee, which will be discussed before work proceeds.
OWNERSHIP RIGHTS
Upon receipt of full payment, the Company grants the Client a standard license for the book cover.
The Company retains copyright ownership of all design concepts and draft materials.
The Company reserves the right to display the Client’s final book cover design, author name, and book title in its portfolio and promotional materials.
CLIENT RESPONSIBILITIES
To avoid copyright issues, the Company must confirm with the Client that any files supplied for use in the project are properly licensed.
The Client is responsible for providing files with the appropriate licenses or permissions. Any copyright infringement resulting from Client-provided files remains the Client’s responsibility.
If the Client does not possess the rights to provided files, the Company may refuse to incorporate them into the project and may suggest alternative options.
If the Client wishes to use an AI-generated image in the project, the image must be licensed for commercial use. The Company is not responsible for any copyright disputes arising from AI-generated images supplied by the Client.
The Company does not modify files created by other designers, except for services such as formatting assistance, typography additions, or back cover and spine design.
If the Client hires the Company to continue or expand upon another designer’s work, such as creating an additional cover in a series, the Client must obtain permission from the original designer. This allows the Company to maintain consistency with previous cover designs. This requirement may be waived if the original designer cannot be contacted or if no agreement with the original designer is violated.
